However, even with the proliferation of biking lanes and greenways, bicyclists are still put at substantial risk of motor vehicle accidents. He is a strong supporter of bicyclists’ rights to share the road with other vehicles. He has also written several articles about bicycling and the law.
New Jersey biking statutes
Motorists are required to share the road with bicyclists. Cyclists also have a duty to comply with New Jersey laws, including:
- If younger than 18 years old, wear a helmet.
- Use appropriate lights while riding at night — including a white lamp in the front and a red lamp in the back.
- Equip the bike with a bell that can be heard from at least 100 feet away.
- Make sure the brakes function properly.
- Keep hands and feet on the pedals and handlebars.
- Never tow a passenger.
- Ride to the right of the roadway, except when making a left turn, avoiding a hazardous condition, passing a slower vehicle or traveling at the same speed as automobiles.
- Obey all local and state traffic laws.
These rules are summed up in NJ statute 39:4-14.1, Rights and Duties of Persons on Bicycles: “Every person riding a bicycle on a roadway is granted all the rights and subject to all of the duties of the motor vehicle driver.”
What to do after a bicycle accident
Unfortunately, even when taking every precaution, you may still become the victim of an auto accident. Just as if you were in a car at the time of your traffic accident, take action to protect your health and preserve your legal rights. Promptly get the medical care you need. Also, make sure you get the driver’s information so you can file a claim with the person’s auto insurance company. If you are the victim of a hit-and-run, you may have options under your own insurance policy.
